By accessing, downloading, installing, registering for, subscribing to, or using FieldVision AI™ (the "Service"), operated by Capitol Notary LLC and the Tabellio Network™ ("Company," "we," "us," or "our"), you ("User," "you," or "your") expressly acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions, our Usage Policy, and our Copyright Notice (collectively, the "Agreement"). If you do not agree, you must not access or use the Service.
The Service is intended for use by licensed and qualified inspectors, insurance adjusters, contractors, restoration professionals, property managers, and similar field-service professionals. You represent and warrant that you are at least 18 years old and legally authorized to perform the inspection, documentation, or reporting work for which you use the Service.
FieldVision AI is a productivity tool. It is not a substitute for professional inspection, engineering, legal, insurance, or other expert judgment.The Service uses artificial intelligence, computer vision, voice-to-text transcription, and automated report generation. These technologies are not perfectand may produce errors, omissions, mis-transcriptions, hallucinations, mislabeled findings, inaccurate measurements, or incomplete documentation.
You are solely responsible for performing your own due diligence on every inspection, including but not limited to: physically verifying conditions on site, independently confirming all measurements and observations, proofreading and correcting all AI-generated text and voice transcriptions, validating photographs and annotations, and ensuring every report complies with applicable codes, standards, contracts, licensing requirements, and the standard of care of your profession before you sign, certify, deliver, or rely on it.
You agree that the final inspection report, certification, and any decisions made in reliance on the Service are your professional work product and your sole responsibility.
You agree to provide accurate registration information and to keep your credentials confidential. Paid subscriptions auto-renew at $19.99/month (or the then-current rate) until cancelled. You may cancel at any time through your account; cancellation stops future billing but does not entitle you to a refund of fees already paid.
You agree to use the Service only for lawful purposes and in accordance with our Usage Policy. You will not misuse, reverse-engineer, resell, scrape, or interfere with the Service, and you will not upload content you do not have the right to upload.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT AI-GENERATED CONTENT, VOICE TRANSCRIPTIONS, OR AUTOMATED ANNOTATIONS ARE ACCURATE, COMPLETE, CURRENT, OR FREE FROM ERROR.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING ANY CLAIMS BASED ON ERRORS IN AI-GENERATED REPORTS, FAULTY VOICE-TO-TEXT TRANSCRIPTION, MISIDENTIFIED DAMAGE, OR INSPECTION OMISSIONS. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless the Company and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your reports, your professional services, your violation of this Agreement, or your violation of any law or third-party right.
This Agreement is governed by the laws of the State in which Capitol Notary LLC is organized, without regard to conflict-of-laws principles. You consent to exclusive jurisdiction and venue in the state and federal courts located there.
We may update this Agreement from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
